SOULFest Sweepstake Rules
NO PURCHASE NECESSARY. PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE CHANCES OF WINNING.
This is a sweepstake (the “Sweepstake”) sponsored by Yoga Alliance (the “Sponsor”), 4201 Wilson Blvd., Ste. 605, Arlington, VA 22203.
Void where prohibited by law. Sweepstake is subject to all applicable national, federal, state, and local laws.
ELIGIBILITY: This Sweepstake is open to any individuals aged 13 and older.
DRAWING/ODDS. On or around October 18, 2022, potential prize winners will be selected in a random drawing from all eligible entries received by the Sponsor. Odds of winning depend on the number of eligible entries received for the Sweepstakes. By entering the Sweepstake, Entrants fully and unconditionally agree to be bound by these Official Rules and the decisions of the Sponsor, which will be final and binding in all matters relating to the Sweepstakes.
PRIZES. One (1) prize will be awarded, each consisting of a three-year Empire Pass. The approximate retail value of each three-year Empire Pass is $205.
WINNER NOTIFICATION: Winners of the Sweepstake will be contacted by October 18, 2022, via the email address on file with Sponsor. Winners must provide their shipping address; and Sponsor will mail the prize to the shipping address. In the event that an Entrant fails to provide their shipping address within 7 days of the notification, the Entrant will be disqualified and an alternate prize winner will be selected in a random drawing.
USE OF DATA. Sponsor will be collecting personal data about Entrants online, in accordance with its privacy policy. Please review the Sponsor’s privacy policy at https://www.yogaalliance.org/AboutYA/OurPolicies/PrivacyPolicy. By participating in the Sweepstakes, Entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy.
RELEASE AND WAIVER: By participating in this Sweepstake, Entrants agree to release, discharge and hold harmless Sponsor, and their respective parents, affiliates, subsidiaries, and agents, and the respective officers, directors, shareholders, employees, agents and representatives of the foregoing (collectively, "Released Parties") from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from Entrant's participation in the Sweepstake or the acceptance, possession, use or misuse of any awarded prize (or portion thereof), including any/all travel/activity related thereto. Further, any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstake, but in no event attorneys’ fees; and under no circumstances will the member be permitted to obtain awards for, and the Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
GENERAL CONDITIONS: By participating in this Sweepstake, Entrants agree: (a) to abide by these Sweepstake Rules and decisions of Sponsor, which shall be final in all respects relating to this Sweepstake; (b) Sponsor may disqualify anyone from participating in the Sweepstake or winning the prize (and void all associated entries) if, in its sole discretion, it determines that such person is attempting to undermine the legitimate operation of the Sweepstake by cheating, deception, or other unfair or inappropriate practices; (c) Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision; and (d) Sponsor reserves the right in its sole discretion to cancel, modify, or suspend any portion of the Sweepstake for any reason.
CHOICE OF LAW AND FORUM: These Sweepstake Rules and any claims or disputes arising out of the Sweepstake shall be governed by the laws of the State of Virginia, USA. Entrants agree to the exclusive jurisdiction and venue in tribunals located in the Eastern District of Virginia, USA.
